Turlough is steadily acquiring considerable experience before a range of courts and tribunals, including the Privy Council and the Chancery and Queen’s Bench Divisions of the High Court of Justice (including the Companies, Commercial and London Mercantile Courts), as well as county courts and the Lands Tribunal.

Aviation & Travel

Instructed in relation to a number of disputes arising out of aircraft purchase agreements.

Banking & Finance

Turlough has a particular interest in retail banking, market regulation (principally in the area of debt and structured finance), money laundering, commercial fraud and financial services in general.  He has advised and appeared on behalf of a wide range of domestic and international clients, including high net worth individuals, banks and building societies, as well as the Financial Ombudsman Service.

Recent cases on which Turlough has been involved include:

  • advising on a number of debt and equity programmes for UK, Irish and US financial institutions);
  • advising on a scheme of arrangement for the reinsurers of liabilities underwritten by a defunct insurance company;
  • advising the special servicer of a securitised pool of mortgage loans on the circumstances arising from a default on those loans.

Dry Shipping, Commodities & Transport

Turlough accepts instructions in all aspects of the transport of goods, particularly CMR claims.

Commercial Litigation

Turlough’s practice embraces a wide range of contentious and non-contentious commercial work, including professional liability, contractual disputes and property transactions.

Many of the cases on which Turlough has worked involve cross-border transactions or disputes, giving him experience of advising on and litigating questions of foreign law and choice of law.  Turlough has also advised on, and appeared in applications for, interim remedies in commercial disputes, including freezing and disclosure orders and Norwich Pharmacal injunctions

Recent and ongoing commercial and corporate cases include:

  • instructed  in a significant professional liability claim by provisional liquidators of an insurance company against the company’s former actuaries: Independent Insurance Limited v. Watson Wyatt (settled);
  • advising on the justiciability of the acts of a head of state in relation to an international metallurgical contract traded on the LME;
  • advising on the winding-up of an incorporated charity and the distribution of its assets;
  • instructed as junior counsel in a commercial appeal before the Judicial Committee of the Privy Council from the Supreme Court of Mauritius: Daby v. State of Mauritius [2007] UKPC 41;
  • regularly instructed in strike-out/summary judgment applications in the High Court.

Local Government Law

Turlough has advised and acted for local authorities on a wide range of commercial, planning, housing, licensing and public law matters.
