LIDW25: To Catch a Thief: recovering the proceeds of fraud in England and DIFC/ADGM

Time: 11:00 - 12:30
Venue: Trowers & Hamlins, 3 Bunhill Row, London EC1Y 8YZ

OVERVIEW

Join us, Trowers & Hamlins and 3VB for this panel session discussing the recent case law developments from the English courts as well as the DIFC and ADGM courts on interim remedies available to victims of fraud.

Recent judgments have looked at:

  1. When freezing orders in England can be obtained in support of DIFC proceedings
  2. The use of Norwich Pharmacal orders in connection with foreign proceedings and differences of approach between the DIFC and English courts
  3. The availability of various legal remedies in the context of crypto fraud
  4. The "immovables rule" that a foreign Court has no jurisdiction to make orders in respect of land situated in England and that rights relating to such land are governed exclusively by English law
  5. Claims for knowing receipt and the requirement to hold a proprietary interest
