Jeremy Richmond KC and Benjamin Joseph successfully represented one of the defendants in securing the dismissal of a USD 100 million fraud claim brought in the Abu Dhabi General Markets Court by one of the largest companies in the UAE, Union Properties PJSC.

Union Properties alleged fraudulent breaches of directors’ duties under the UAE Civil Code, and a conspiracy involving multiple co-defendants. Following a multi-week trial, all claims were dismissed in their entirety. The judgment emphasises the importance of precision when pleading allegations of fraud and / or bad faith in addition to including a number of observations regarding directors’ duties under the UAE Civil Code.
