The Court of Appeal has considered the jurisdictional gateway for service out of the jurisdiction provided by CPR PD 6B para 3.1(6), expressing the opinion that where a claim is made under or pursuant to a contract, that is the contract “in respect of which” it has to be shown, to the standard of a good arguable case, that it exists and that one or other of the requirements of para 3.1(6) has been met.

The Commercial Court has recently provided much needed guidance on the construction of Conwartime 1993 in the context of the piracy problem in the Gulf of Aden. Remarkably, given the regularity with which that clause or Conwartime 2004 (which is in similar terms) has been incorporated into time charterparties since 1993, this appear to be the first occasion upon which its meaning has been considered by the Court.
