OVERVIEW

Jeremy Richmond KC will be presenting on the impact of shipping lines insolvency on international trade contracts and will consider some practical strategies for dealing with such insolvencies.

He will consider recent English insolvency legislation and case law as it impacts on the international maritime lawyers including the effects of the recognition of foreign insolvency proceedings in England under the UNCITRAL Model Law on Cross-Border Insolvency (as enacted in England), and potential differences in interpretation of the Model Law between the English and Singapore courts.

He will also talk about the recent important developments in the English common law as regards the recognition of foreign insolvency procedures, and the provisions of the new English Corporate Insolvency and Governance Act 2020 as they impact on the exercise of contractual/charterparty rights under English law.
