OVERVIEW

Thank you to all who joined Jeremy Richmond KC and Emily Saunderson as they presented a talk on the Corporate Insolvency and Governance Act 2020, as well as recent trends in the case law on insolvency law. 

It has been over three years since the Corporate Insolvency and Governance Act 2020 (“CIGA”) introduced fundamental changes to UK insolvency law including measures aimed at helping companies survive the effects of Covid-19.  But as the effects of CIGA become clearer, practitioners are increasingly being asked for advice about (among other things) the CIGA restructuring plan, and the implications of the so-called ipso facto provisions, which restrict the rights of a party to terminate a contract for the supply of goods and services in the event of counterparty insolvency.

This Quadrant Chambers seminar provided a useful overview of the recent changes to CIGA and current insolvency trends including a consideration of recent case law on CIGA restructuring plans.
