Manchester - Injunctions Update: freezing, antisuit and final injunctions recent developments

OVERVIEW

We are very pleased to be coming back to Manchester to hold an in person commercial update event, this time looking at recent developments in injunctions.  

Our panel consists of Thomas Macey-Dare KC, Robert Ward & Maya Chilaeva who will be will be discussing.

  • Freezing injunctions - we will focus on the courts' move away from the limited approach to interim relief in The Siskina, culminating in Broad Idea v Convoy, and the implications for the availability of freezing injunctions today.
  • Antisuit injunctions - we will be focusing on the ability, post-Brexit, to obtain anti-suit relief to restrain proceedings in EU / EFTA member states, as illustrated by QBE Europe v Generali Espana de Seguros [2022] EWHC 2062 (Comm) and Ebury Partners v Technical Touch [2022] EWHC 2927 (Comm).
  • ​Final injunctions - this is focusing on the recent spate of cases about injunctions against trespassers and other groups of potential tortfeasors, the latest of which is the Court of Appeal decision in London Borough of Barking & Dagenham v Persons Unknown [2022] EWCA Civ 13, which was appealed to the Supreme Court sub nom. Wolverhampton City Council v London Gypsies and Travellers and was argued in the Supreme Court in February.
