Electronic Bills of Lading: where do we stand? - Michael Howard QC

The English Law Commission has come up with a report on the merits of electronic bills of lading and a draft bill to facilitate their use.  Three questions present themselves: first, how well thought out is the policy?  Secondly, how good is the draft?  and thirdly, is change likely? 

Terminating charterparties for breach: the eye of the needle? - Simon Rainey QC

An analysis of the classification of terms in shipping contracts,  discussing whether judicial preference for innominate terms over conditions has made it too difficult for an “innocent party” to terminate a shipping contract for the other party’s breach. 

Sanctions – an uncertain time? - Nigel Cooper QC

Nigel reviews some of the on-going uncertainties arising in connection with sanctions with particular reference to P & I cover and claims. 

Unseaworthiness and Passage Planning - John Russell QC

John will analyse the recent landmark decision of the Supreme Court in The CMA CGM LIBRA and discuss the impact the case will have on the many cases currently before courts and tribunals (or in the pipeline) in which allegations concerning defective passage planning have been raised.  

The risk of parent company liabilities for contracts made by subsidiaries - John Passmore QC

Following the Court of Appeal judgment in Kawasaki v JKL (2021), John provides a guide to proving and avoiding parent company liability for contracts made by subsidiaries. John deals with parent company liability under the concealment principle, liabilities in tort for breach of contract by a subsidiary, and potential defences.
