Stephen Cogley Q.C and Liisa Lahti examined this recent Court of Appeal judgment, described by Lloyd’s List as “the most spectacular shipping legal imbroglio so far this century”, and considered the ramifications of the decision including its effect upon the conventional understanding of “retention of title” clauses and its future impact on the supply of consumables on credit terms subject to such clauses.
